Terms of Service

1. General provisions

These Terms set out the rules for providing services by electronic means through the website at bondsoft.pl (the "Website"), in accordance with Article 8 of the Polish Act of 18 July 2002 on providing services by electronic means.

The service provider is Oleksandr Bondarenko, a sole trader registered in Poland under the business name Oleksandr Bondarenko Software Solutions (trading as BondSoft), ul. Jana Heweliusza 11, 80-890 Gdańsk, Poland, NIP 5833576264, REGON 545434529 (the "Provider").

"User" means any person using the Website.

2. Types and scope of services

The Provider offers the following services free of charge:

  • Access to content — browsing information about the Provider's offer;
  • Contact form and questionnaire — submitting an enquiry and a phone number to be contacted back;
  • Free technical website scan — a tool producing a report on the performance and accessibility of a given website (the "Scan");
  • Call appointment booking — a tool for choosing an available consultation slot and receiving a confirmation and a reminder at the e-mail address provided.

All of the above are free for the User and create no obligation to enter into any paid agreement.

Consulting and implementation services (designing, building and maintaining software) are not provided through the Website and are governed by separate individually negotiated agreements.

3. Technical requirements

Using the Website requires a device with internet access and a current web browser with JavaScript enabled; to receive a callback, an active phone number or email address is also required.

The Website stores no cookies on the User's device and uses no browser storage. Blocking cookies does not limit the use of the Website.

The Provider notes that use of the internet carries typical risks, in particular malicious software and interception of transmissions by unauthorised parties. The Website is served over an encrypted connection (HTTPS).

4. Rules of use

The User must use the Website lawfully and in good faith, respecting the personal rights and intellectual property of third parties.

Supplying unlawful content is prohibited, including content infringing third-party rights, offensive or misleading content, and content containing malicious software.

Users should not submit special categories of personal data (sensitive data) or third parties' personal data without their consent.

The Provider reserves the right to cease providing services to a User who breaches this section.

5. Free technical scan — nature and limitations

The Scan covers: a performance and accessibility measurement (Google PageSpeed Insights API), a GET request for the page's HTML, a single TLS connection on port 443 to read the certificate, a single request to port 80 to check the redirect to HTTPS, a lookup of the address in the public Google Safe Browsing database, a reading of the domain expiry date from the public registry (the RDAP protocol), a reading of the domain's public DNS records (SPF, DMARC), and retrieval of the /robots.txt, /sitemap.xml and /llms.txt files. The report may include an aggregate summary — how many of the other sites checked with this tool scored higher. That summary is computed from the results of earlier scans, contains no addresses and requires no additional requests to any website.

All of these operations are strictly passive — they amount to reading publicly available information, within a scope no wider than what an ordinary browser or search-engine crawler performs. The Provider does not scan ports, does not test for vulnerabilities and makes no attempt to obtain unauthorised access.

The address supplied by the User is transmitted for this purpose to Google (PageSpeed Insights, Safe Browsing), to domain registry operators and to public DNS servers. The Provider has no influence over the results returned by those tools or over their availability.

The report is informational and indicative only. It is not an audit within the meaning of any legal provision, nor an expert opinion, guarantee, legal or investment advice. Results may vary between measurements and depend on factors outside the Provider's control.

The User should only submit addresses they own or are authorised to test. Responsibility for the choice of address rests with the User.

The Provider is not liable for business decisions taken solely on the basis of the report.

6. Conclusion and termination of the agreement

An agreement for the provision of a service by electronic means is concluded when the User begins to use that service — respectively upon displaying a page, submitting a form, or launching the Scan.

Agreements covering content access and the Scan are one-off and terminate when the User stops using the service or leaves the Website. The User may stop using the Website at any time at no cost.

Where a form has been submitted, the agreement terminates once the Provider has responded, or earlier at the User's request sent to office@bondsoft.pl.

Because the services provided through the Website are free of charge, no financial obligations arise for the User and withdrawal carries no fees.

7. Complaints procedure

Complaints regarding services provided by electronic means may be submitted to office@bondsoft.pl or in writing to the Provider's address given in section 1.

A complaint should identify the User (contact details allowing a reply), describe the objection and, where possible, state the date and circumstances of the problem.

The Provider will consider the complaint and reply within 14 days of receiving it, to the address indicated by the User. Failure to reply within that period means the complaint is upheld.

A User who is a consumer may use out-of-court complaint and redress mechanisms, including the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr. Use of these mechanisms is voluntary.

8. Personal data

The rules for processing personal data, including legal bases, recipients and the rights available to you, are set out in the Privacy Policy, which supplements these Terms.

Providing data in the forms is voluntary but necessary to receive a reply.

9. Intellectual property

Content published on the Website — including texts, graphics, layout and source code — is legally protected and belongs to the Provider or is used under appropriate rights.

Case studies and interface visualisations shown on the Website are illustrative and demonstrate the range of possible solutions; they are not an offer within the meaning of Article 66 of the Polish Civil Code, nor a description of specific implementations for named clients.

Some photographs inside those visualisations were generated with an artificial-intelligence image tool and are marked as such next to the visualisation. They do not depict real goods, real interiors, a real shop or a real company, and they carry no claim about any product, service or price.

Copying and distributing material from the Website without the Provider's consent is prohibited.

10. Final provisions

The Provider may amend these Terms for important reasons, in particular changes in law or in the scope of services offered. The current version is always available on this page together with the date of the last update.

Matters not covered by these Terms are governed by Polish law, in particular the Civil Code and the Act on providing services by electronic means.

Nothing in these Terms excludes or limits consumer rights arising from mandatory provisions of law.
